Facts of the case:

 

Alfred, and his classmates were ordered to leave their classroom by the school's principal. They were required to walk past a deputy sheriff and his drug-sniffing dog. The dog alerted on one student (not Alfred). The dog was then used to sniff backpacks, jackets and other personal belongings left in the classroom. When the students returned to class, the dog again alerted on the same student. That student was taken away and searched. No drugs were found either on the student or in the classroom. Alfred sued in federal court (per 42 U.S.C. Section 1983) alleging deprivation of his Fourth Amendment right to be free from unreasonable searches and seizures.
