 Mello-Granlund Older Californians Act  of 1965 is inacted to protect seniors

 

Between 1 and 2 million Americans age 65 or older have been injured, exploited, or otherwise mistreated by someone on whom they depended for care or protection.
Elder abuse defined refers to any knowing, intentional, or negligent act by a caregiver or any other person that causes harm, or a serious risk of harm, to a vulnerable adult. In California, anyone age 65 or older is protected by a special set of laws called The Elder Adult and Dependent Adult Civil Protection Act ("The Elder Abuse Act"), which is a powerful set of laws designed to help prevent neglect and abuse to California seniors. (Welf & I C 15600 et seq.) Under The Elder Abuse Act, "abuse" is defined includes any physical abuse, neglect, financial abuse, abandonment, isolation, abduction, or other treatment resulting in physical harm or pain or mental suffering.

Any mandated reporter who, in his or her professional capacity, or within the scope of his or her employment, has observed or has knowledge of an incident that reasonably appears to be physical abuse, abandonment, abduction, isolation, financial abuse, or neglect, or is told by an elder or dependent adult that he or she has experienced behavior, including an act or omission, constituting physical abuse, abandonment, abduction, isolation, financial abuse, or neglect, or reasonably suspects that abuse shall report the known or suspected instance of abuse by telephone immediately or as soon as practically possible, and by written report sent with two working days.”

(Welfare and Institutions Code Section 15630)

 

Mandated reporting parties come from, but are not limited to, the following categories:

  • Health care practitioners, e.g. doctors, dentists, nurses, therapists, and their office staff
  • Adult personal care providers, e.g. attendants, day care staff, senior center staff
  • Law Enforcement Officers
  • Medical Examiners
  • Paramedics and firemen
  • Code enforcement and animal control workers
  • Clergy
  • Adult/Child Protective Services staff
  • All staff of Orange County Social Services Agency having client contact
  • After Jan. 1, 2007, employees of financial institutions
