Then answer the following questions: (please post the questions with your answers as it is easier to grade)

1. What is an "unlawful detainer" and what does it mean it is a "summary court procedure"

2. How many days does a tenant have to answer an unlawful detainer complaint, and which code section states the number of days?

3. A Judge will hear the U.D. case within how many days after the tenant files and answer? which code section?

4. If the landlord uses unlawful methods to evict a tenant, the landlord may be subject to what kind of liability? which code section?

5. How long will the judgment against the tenant be reported on the tenant's credit report, and which code section?

6. What is a writ of possession and how does it work?

7. What happens if the court finds a tenant acted maliciously in not giving up the rental unit? what sanctions? what code section?

8. Explain three of the tenant's defenses to a landlord's eviction.

9. If you feel that a landlord did not properly serve you what motion would you file? If you believe the complaint has a technical defect what motion would you file?

10. What is a default judgment? What is the purpose of serving a "prejudgment claim of right of possession? What code section applies?
